Drattzy Games website and community terms

Where these terms apply

Drattzy Games LLC runs the Drattzy studio sites at drattzy.com and drattzygames.com, the Alterium Shift site at alteriumshift.com, and the community at hub.drattzy.com. These terms describe participation in those websites and the community features we offer.

A game purchase, a campaign pledge or a storefront account can have its own terms. These website terms do not replace a game's licence, change a storefront's transaction terms, or take away a reward we have already promised. A feature described here is available only where we actually offer it.

Our Privacy Policy explains how information is handled. Reading that notice is separate from agreeing to these terms, and neither action is a subscription to marketing.

This is one shared Terms document. Part A contains general website and studio provisions that apply to the covered sites and relevant community features. Part B contains rules for the community features it describes. Part C covers updates and contact details. A feature-specific provision applies only where that feature is offered and used.

Part A — General website and studio provisions

Studio material and press coverage

Our artwork, game material, site design and other studio material belong to us or their respective rights holders. Access to a website does not give permission to distribute a game, sell our artwork, use our branding as your own, or suggest that we endorse your work.

We welcome reporting, reviews, streams and other coverage. When we clearly identify material as a press asset, you may reproduce it in coverage of Drattzy Games or the relevant game, including monetized coverage, with credit to Drattzy Games and the game where applicable. Use the material without misrepresenting it or implying sponsorship.

This permission covers only rights we can grant. Follow any asset-specific conditions or third-party restrictions displayed with an asset. Material that is not designated for press use is outside this permission; rights independently available under law are unaffected.

Service changes and your rights

Websites and community features can change, and maintenance or technical problems can interrupt access. A description of a planned feature is not a guarantee that it will be released. Changes to free website features do not cancel a separate paid purchase or a reward obligation.

You keep rights and remedies that the law does not allow a contract to remove. Nothing here requires you to waive those rights, prevents a lawful complaint to a regulator, or turns a privacy notice into consent for every use of information.

Website availability and warranties

Except for an express promise we make to you and protections required by law, our websites, community features and general content are provided in their current form and as available. As far as applicable law permits, we give no additional express or implied warranties, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise uninterrupted access or operation without errors or harmful code.

These provisions do not cancel a game purchase, override applicable storefront or campaign terms, or reduce an earned or promised reward. They do not remove our responsibilities for our own handling of personal information.

Information and third-party services

We try to keep studio information accurate, but general website material can contain mistakes or become out of date. We may correct or update it. Member contributions reflect their authors’ statements, not a guarantee from Drattzy. This does not remove a duty imposed by law or an express commitment we have made.

Our sites can link to or offer optional connections with services run by others. A link or connection alone does not mean we endorse or guarantee that provider’s content or service. Its terms and privacy practices may differ from ours. We remain responsible for our own applicable obligations.

Limits on liability

To the extent permitted by applicable law, Drattzy Games LLC will not be liable for indirect, incidental, special or consequential losses arising from use of, or inability to use, our websites or community features. This includes resulting loss of profits, business opportunities or data, even if we were told that such losses might occur.

These limits do not apply to fraud, intentional wrongdoing, conduct greater than ordinary negligence, or any liability that cannot lawfully be excluded or limited. Nothing in these terms removes a mandatory consumer right or remedy, or excuses an existing purchase or reward obligation.

If a provision cannot be enforced

If a provision cannot lawfully be enforced, it will not apply to the extent of that restriction. The remaining provisions continue to apply to the extent permitted by law.

Governing law and courts

These terms and disputes arising from them or from use of our websites and community are governed by Minnesota law. If mandatory consumer law gives you protections that cannot be removed by agreement, those protections continue to apply.

Unless applicable law gives you the right to bring a claim elsewhere, court proceedings about these terms or use of our websites and community must be brought in a state or federal court in Minnesota with authority to hear the claim. Nothing in these terms removes a legal right to use another court, obtain a mandatory remedy, or make a complaint to a regulator.

Part B — Community features only

This part applies to community accounts, participation, contributions and reward-access features. The 13+ account declaration and registration process concern community accounts. Browsing our studio or game marketing pages does not require forum registration or activation of community posting or reward-access features.

Joining and protecting an account

Community accounts are for people aged 13 or older. Any additional requirements that apply where you live must also be satisfied. Creating an account requires affirmative agreement to the version of these terms shown during registration. If you register during the notice period for an announced material revision, we will show both the current and upcoming versions and their effective dates. To complete registration, you must affirmatively accept each version separately. We will keep a separate record of each acceptance identifying the exact version and acceptance time. The current version applies until the upcoming version takes effect on its stated date. If you do not agree to the required terms, do not complete registration.

If an existing or migrated account has no current eligibility declaration or Terms acceptance record, we will ask for both at the next sign-in before allowing further posting. Recovery, security and privacy controls, support, public reading and existing rewards remain available through their appropriate routes while this is resolved. We will not treat the absence of an old receipt as evidence that you previously agreed.

The eligibility declaration is an unchecked confirmation that you are at least 13, recorded with its time. It is a self-declaration, not independently verified age. We do not ask for a birth date or identity documents as part of that declaration. Additional safeguards required by applicable law still apply.

Use an email address you control, complete the required email verification, and keep your sign-in credentials private. Contact support if you suspect someone else has gained access. Do not obtain access through another member's credentials or misrepresent who controls an account.

An external sign-in or account link is optional where offered. It can require confirmation that you control both accounts. An email-address match alone does not authorize merging accounts. Linking a provider does not sign you up for newsletters or private Discord messages.

Participating in conversations

Public posts, replies and public profile details can be read by other people. Think carefully before including information that identifies you or someone else. Do not publish passwords, private game keys or another person's private information. Share only material you are entitled to share.

Follow the community rules displayed for the relevant area. Do not threaten or harass people, impersonate others, distribute malicious software, interfere with the service, send spam, or use the community to violate another person's rights. Ordinary disagreement and criticism remain subject to the same rules as other participation.

Staff handle reports, content restrictions and account restrictions through the community rules and the moderation and appeal process. Those rules and processes explain how to raise a concern or request review. These terms do not create an additional appeal deadline.

Editing a post can leave a history of earlier versions with editing details. Earlier versions do not expire automatically. Privacy, safety or legal issues can require removal or redaction, including from history. Hiding a discussion restricts its visibility; it is not the same as deleting every retained copy.

Your contributions remain yours

You keep the rights you own in your contributions. Posting gives us the permission needed to make the community work: we can store and copy the contribution, present it to the audience for that part of the community, make technical display adjustments, and handle it in moderation and recovery systems. This permission is non-exclusive and limited to operating the community.

Providers working for us can perform those tasks on our instructions. The permission lasts only as long as the permitted handling of a retained contribution requires, subject to the retention rules and applicable rights. It does not give us ownership of your work or permission to reuse it in advertising or to train AI models. Those uses would require separate permission.

Account closure can leave useful public conversations available under the name “Deleted user”, as explained in our Privacy Policy. The limited permission above continues for those retained contributions. Removal from public view does not permit unrestricted use of any remaining copy.

Supporter benefits and purchases

Eligibility review, benefit assignment and delivery are different steps. A verification result or account display alone is not confirmation that a particular reward has been delivered.

The relevant campaign, tier, purchase or offer determines the benefit promised. Once earned, rewards do not expire. These website terms do not add a fee, shorten an existing benefit or cancel an unfulfilled reward. We retain the minimal record needed to prove and preserve earned rewards, with no automatic age-based expiry. Closing a community account does not cancel an earned reward or automatically delete the record needed to preserve it. Applicable privacy and legal obligations still apply to the information retained. Contact support when an account record appears inconsistent with an existing commitment.

A community ban or restriction does not by itself cancel a reward you have already earned or were promised. If the restriction prevents you from accessing that reward, contact support. After verifying ownership and eligibility, staff can arrange an appropriate alternative delivery route where available. This does not lift the restriction, restore community privileges or grant new benefits. Suspected fraud, disputed eligibility and legal restrictions are reviewed separately; a matching email address alone does not authorize a transfer.

A separate campaign or store service can require its own login and handle its own records. Following a BackerKit or storefront link does not mean that all of its account or purchase information has been imported into our community.

Leaving the community

You can ask support to close an account and use the privacy contact for a request involving personal information. We may need proportionate evidence that the request comes from the account holder. Our Privacy Policy distinguishes private account records, public contributions, edit history, moderation records and recovery copies.

Closing an account does not by itself erase every discussion that others have joined. Tell us if retained content contains identifying information or presents a privacy or safety concern. Existing reward commitments and applicable legal rights continue to be considered when the request is handled.

Part C — Updates and contact

The community registration, member-notice and posting-acceptance processes described below concern community accounts. They do not require forum registration for ordinary browsing of our marketing sites. Requirements imposed by applicable law remain unaffected.

Future versions of these terms

We may revise these terms to reflect changes to the services, applicable law or security requirements. We will identify the replacement version and its effective date.

For existing members, if a change materially affects their rights or obligations, we will give at least 30 days' notice before it applies, both through an in-account notice and an email to the account's verified address. These service notices are separate from optional newsletters and activity subscriptions. An earlier change is permitted only to the extent needed to meet a legal requirement or address an urgent security risk. We will give as much notice as reasonably possible and explain that exception.

For every revision that materially affects members' rights or obligations, we will require fresh affirmative acceptance of that exact version before further posting once it takes effect. Separate advance acceptance of the exact upcoming version during registration records agreement to that version only and does not make it effective earlier. Registration during a notice period does not shorten the full notice period for existing members. Recovery, security and privacy controls, support, public reading and existing rewards remain available through their appropriate routes while acceptance is pending. Typo or formatting fixes do not require a new acceptance prompt. Changes that do not materially affect rights or obligations may apply when posted, subject to applicable legal requirements. Closing an account before a change takes effect does not remove an obligation or legal right that already exists.
